These Terms of Use ("Terms") govern your use of the AC Remote Control: Universal mobile application ("the App"), package name com.coolhome.acremote.universal, provided by the developer of the App ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License grant
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Android devices that you own or control, solely for your personal, non-commercial use, and subject to these Terms and the Google Play Terms of Service.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority where you live, you must have permission from a parent or legal guardian.
3. Hardware requirements & compatibility
The App controls air conditioners by transmitting signals through your device's built-in Infrared (IR) Blaster. Devices without IR hardware cannot control air conditioners with this App. Compatibility with any particular air-conditioner model or brand is not guaranteed. The App offers multiple remote profiles you can test; you are responsible for selecting the profile that works with your unit.
4. A free, ad-supported app
The App is provided free of charge and is supported by advertising. By using the App, you acknowledge that ads will be displayed and that advertising and analytics providers process certain information as described in our Privacy Policy. The App currently has no in-app purchases or subscriptions.
5. Acceptable use
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except where such restriction is prohibited by law.
- Copy, modify, distribute, sell, rent, or sublicense the App or any part of it.
- Use the App for any unlawful purpose or in violation of any applicable law or regulation.
- Interfere with, disrupt, or attempt to gain unauthorized access to the App or its related systems.
- Circumvent or disable any advertising, security, or usage-control features of the App.
6. Your content & settings
Any remote configurations, device names, and preferences you create are stored on your device. You are responsible for maintaining backups. Uninstalling the App or clearing its data will remove these settings.
7. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be compatible with every device or air-conditioner model, that it will be uninterrupted or error-free, or that defects will be corrected. This App is an independent utility and is not affiliated with, endorsed by, or sponsored by any air-conditioner manufacturer. Brand names are used solely to indicate compatibility.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE PRIOR 12 MONTHS (WHICH, FOR A FREE APP, IS ZERO) OR USD 10.
9. Indemnification
You agree to indemnify and hold harmless the developer from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the App or your violation of these Terms.
10. Termination
These Terms remain in effect while you use the App. We may suspend or terminate your access at any time if you violate these Terms. You may terminate at any time by uninstalling the App. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will continue to apply.
11. Google Play distribution
You acknowledge that these Terms are between you and the developer only, and not with Google. The App is distributed through Google Play and your use is also subject to the Google Play Terms of Service and the Google Privacy Policy. Google is not responsible for the App or its content. You agree to comply with all applicable third-party terms and with U.S. and other applicable export-control laws when using the App.
12. Governing law
These Terms are governed by and construed in accordance with the laws applicable at the developer's principal place of business, without regard to conflict-of-law principles. Mandatory consumer-protection rights available to you in your country of residence are unaffected.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, through the App or Google Play release notes. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
